The term “Student” includes all persons taking courses at the College, including: full-time and part-time, credit, Adult Education, and Continuing Education students. Persons who are not officially enrolled for a particular term but who have a continuing relationship with the College are considered "students."
The term “continuing relationship” means any person who has been enrolled as a student and evidence exists of an immediate future re-enrollment at the College such as transient students, students off for the summer term but registered for the immediate fall term, and students on break between terms in which they are a registered student.
The term “Faculty Member” means any person hired by the College to conduct teaching, service, or research activities.
The term “College Official” includes any person employed by the College, performing assigned administrative responsibilities. In some certain situations, a person may be both student and staff. Determination of student status in a particular situation shall be by the related facts of a particular situation.
The term “member of the College community” includes any person who is a student, faculty member, College Official or any other person employed by Chattahoochee Technical College.
The term “Student Conduct Officer” refers to the person designated by the President, or their designee, to administer the procedures in this code.
The term “policy” is defined as the written regulations of the Technical College as found in, but not limited to, the Student Code of Conduct, Student Handbook(s), College Catalog(s), the College Policy Manual, and the Policy Manual approved by the State Board for the Technical College System of Georgia.
The term "System" means the Technical College System of Georgia.
The term “Academic Misconduct” means any incident involving an act which affects the evaluation of a student’s academic performance or achievement (i.e. cheating, plagiarism, etc.).
The term “complainant” means any person or group who submits a charge alleging that a student/person has violated the Student Code of Conduct, the Academic Misconduct Policy, or the Title IX/Equity policy.
The term “respondent” means any student/person accused of allegedly violating the Student Code of Conduct, the Academic Misconduct Policy, or the Title IX/Equity policy.
The term “advisor” means a person who accompanies a respondent or complainant to a hearing for the limited purpose of providing support and guidance. NOTE: An advisor may not directly address the Conduct officer or hearing board, question witnesses, or otherwise participate in a conduct hearing.
The term “business day” means any day, Monday through Friday, that the College is open for normal business.
The term “grievance” means a matter to be investigated according to formal grievance processes. This includes complaints that are not able to be resolved through informal processes or mediation, and matters relating to allegations of misconduct where disciplinary action against a student or staff member may be an outcome of the investigation.
The term “investigator” means any person or persons authorized by the College to conduct investigations of alleged Student Conduct, Academic Misconduct, or Title IX/Equity violations.
The term “due process” means fair treatment through the judicial process.
The term “sanction” indicates requirements set forth by a hearing panel or administrative hearing upon a finding of responsible for violating the code of conduct, Academic Misconduct policy, or the Title IX/Equity policy.
The term “fact finding meeting” means that an investigator will meet with all parties listed in a grievance or student conduct incident.
The term “grievant” is one who submits a complaint.
The term “interim contact restrictions” is issued when a respondent poses a threat. The Student Conduct Officer can restrict communication between the parties prior to completing an investigation and hearing.
The term “warning” implies a formal notice given to a respondent stipulating that inappropriate behavior or action, if repeated, may lead to a more severe sanctioning through the conduct process.
The term “premises” includes all land, buildings, facilities, and other property in the possession of or owned, used, or controlled by the technical college (including adjacent streets and sidewalks).
The term “Student Organization” refers to groups recognized as official organizations through the Center for Student Involvement.
The “Student Conduct Hearing panel” is comprised of trained members of the college community, including faculty, staff, and students. This panel serves as needed to assist in the adjudication of conduct violations as well as determining appropriate sanctions for the situation.
The “ADA/Section 504 Coordinator” serves as the primary contact for all college instances of alleged violations of federal ADA law, insuring ongoing compliance with ADA/Section 504, and investigating any instances of alleged discrimination in relation to ADA/Section 504.
The “College President or designee” serves as the de facto appellate officer for all student conduct decisions.
